Curious Chef Cookoff Giveaway Official Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
The Curious Chef Cookoff Giveaway (the “giveaway”) starts on August 21, 2022 at 6am Pacific Time (“PT”) and ends on September 3, 2022 at 11:59pm PT (“Giveaway Period”).
ELIGIBILITY: Giveaway is open to legal residents of the United States and the District of Columbia , who are the age of majority in their state of residence and at least 18 years of age as of date of entry. Employees of Cap Hill Brands ("Sponsor") and its subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate families (spouse and parents, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void in Rhode Island and where prohibited by law. Giveaway is subject to all applicable federal, state and local laws.
HOW TO ENTER: To enter the giveaway, you must create a video on Instagram showcasing your favorite recipe to make with kids during the Giveaway Period. You must follow Curious Chef on Instagram, Tag Curious Chef in your video, and use the hashtag #curiouschefcookoff in the caption of your video.
WINNER SELECTION: On or about September 7, 2022 at 12:00PM PT, Sponsor will select one (1) Grand Prize winner and five (5) potential First Prize winners in a random drawing from all eligible entries received throughout the Giveaway Period. Odds of winning depend on the total number of eligible entries received from among all eligible entries received throughout the Giveaway Period.
WINNER NOTIFICATION: On or about September 7, 2022 at 6:00pm PT, the potential winners will be notified via Instagram Direct Message. The potential winners may be required to respond to Sponsor or its designee by Instagram Direct Message within a time period set forth in the notification message. If a potential winner does not respond to the notification within the stated period, the prize will be forfeited, and Sponsor will have no further obligation to such winner. Potential winners may be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents required by Sponsor, which must be returned to and received by Sponsor within five (5) calendar days of issuance. Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by a potential winner (as applicable) may result in disqualification and, at Sponsor's sole discretion, the applicable prize may be awarded to an alternate winner randomly selected from among all remaining eligible entries received.
PRIZES:
- Grand Prize Winner (1): A $1000 shopping spree on Creative QT. Approximate Retail Value (“ARV”) is $1,000
- First Prize Winners (5): A Curious Chef item of choice up to $75. ARV of each prize: $75.
Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. Released Parties (as defined below) disclaim any and all liability for the actual provision, quality or nature of any prize (or portion thereof) accepted by winner. All prize details are at Sponsor’s sole discretion. Total ARV of all prizes: $1,375.
GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Giveaway; (b) to release, discharge and hold harmless Sponsor, their affiliates, subsidiaries, and advertising and promotion agencies, and each of their respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively, "Released Parties") from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant's participation in the Giveaway or any Giveaway-related activity or the acceptance, possession, use or misuse of the awarded prizes; (c) to the use of his/her name, city and state of residence, photograph, entry question/story response, image, voice and/or likeness and prize information for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so. By participating, entrants also agree not to release any publicity or other materials on their own or through someone else regarding their participation in the Giveaway without the prior consent of the Sponsor, which Sponsor may withhold in its sole discretion.
LICENSE/USE OF ENTRIES: By submitting an entry, and to the extent allowed by law, you grant the Released Parties a perpetual, worldwide, royalty-free, non-exclusive, sub licensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse your entry, name, question response, and biographical material including, but not limited to, all materials submitted in connection with the Giveaway in any and all media, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to entrant or any third party.
MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled entries or registrations; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Giveaway, including, without limitation, errors or difficulties which may occur in connection with the administration of the Giveaway, the processing of entries, registrations, the announcement of the prizes, or in any Giveaway-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Giveaway. Released Parties are not responsible for injury or damage to any person's computer or mobile device related to or resulting from participating in this Giveaway or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Giveaways or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Sponsor reserves the right in its sole discretion to cancel or suspend any portion of the Giveaway for any reason. Should any portion of the Giveaway be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, global pandemic, epidemic or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken. In the event of a dispute regarding online entry, entry will be deemed made by the authorized account holder of the email account associated with the entry at the time of entry and he/she must comply with these Official Rules. The authorized account holder is the natural person who is assigned the email address by the Internet Service Provider (ISP), on-line service provider, or other service provider responsible for assigning email addresses. Sponsor may disqualify anyone from participating in the Giveaway or winning a prize (and void all associated entries) if, in its sole discretion, it determines that such person is attempting to undermine the legitimate operation of the Giveaway by cheating, deception or other unfair play practices, or intending to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES (INCLUDING ATTORNEYS’ FEES) AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
RESOLUTION OF DISPUTES: Except where prohibited or otherwise outlined in these Official Rules, entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and entrant agrees to arbitrate any disputes before a mutually agreed upon arbitrator. If the parties cannot agree on an arbitrator within 30 days of the request to arbitrate, the parties shall arbitrate before a JAMS arbitrator under the applicable JAMS rules; (ii) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Giveaway), and entrant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington.
